3.1 What you are buying
A Seller Property Intelligence Report or Buyer Intelligence Report is a digital information product generated from property data, market data, customer-supplied information, derived calculations, statistical methods and, where applicable, modelled analysis. The precise features included are those shown in the order summary when you buy.
The report is designed to help you understand a property and the available evidence. It is not a promise of what a property will sell for, what a seller will accept, what a lender will value it at, or what another professional will conclude.
3.1A Report packs and credits
A report pack is a number of credits that you buy in advance. A credit pays for one report. The number of credits in a pack, its price and how long the credits last are shown in the order summary when you buy it.
A credit expires 365 days after you buy the pack, at the same time of day, and cannot be used after that. My PMD shows how many credits you have left and the date the soonest ones expire.
You use a credit when you ask us to start a report. We set the credit aside when we start the report, and it is used up when the report is ready. If we cannot build the report, the credit is not used up and we look into it.
Credits belong to the account you buy them with and cannot be transferred to another account.
You can cancel a pack within 14 days of buying it. Clause 11.2B of our Complaints, Cancellations and Refunds document explains how, and what we refund.
3.2 Valuation status
Any estimated value, guide price, range, price-per-square-foot figure, confidence score, negotiation range, market position or other price opinion in a PMD report is an evidence-led estimate for information and decision support. It is not:
- a formal valuation for mortgage, secured lending, tax, probate, matrimonial, litigation, accounting or insurance purposes;
- a survey, structural inspection, condition report or environmental report;
- a RICS Red Book valuation unless PMD expressly commissions and identifies a separate service as such;
- a guarantee of achievable sale price, asking price, offer acceptance, future value or transaction outcome;
- legal, financial, mortgage, investment or tax advice.
3.3 No physical inspection
Unless expressly stated otherwise, PMD does not physically inspect the property. Automated analysis cannot reliably observe matters such as actual condition, workmanship, defects, damp, structural movement, boundaries, rights, title, views, noise, smell, neighbour issues, internal finish, hidden extensions, land quality or how a property feels in person.
3.4 Your information
You must provide information honestly and with reasonable care. Where you provide floor area, condition, works costs, tenure, bedrooms, plot information, flood history, improvements, offers, asking price or other facts, PMD may rely on them. Incorrect, incomplete, optimistic or outdated information can materially affect the report.
Where customer information conflicts with authoritative or apparently authoritative records, PMD may use, weight or flag the record according to the methodology. Neither source is guaranteed correct. You should investigate material discrepancies before relying on them.
3.5 Data limitations
Property datasets are incomplete and may contain errors, delays, mismatches, omissions, duplicates, retrospective corrections and inconsistent definitions. Land Registry, EPC, listing, planning, flood, crime, broadband, school, demographic and other datasets each have their own limitations. A lack of recorded information does not prove that a fact, defect, event or risk does not exist.
3.6 Comparables
Comparable properties are selected by automated or semi-automated rules. No comparable is identical to the subject property. Adjustments for time, size, type, condition, location, land, features or market movement are estimates. Particularly unusual, rural, prime, historic, heavily altered, very large, very small or low-transaction properties may have wider uncertainty.
3.7 Buyer-specific terms
A Buyer Intelligence Report may suggest an opening position, target range, evidence-supported reassessment point or negotiating approach. These are analytical suggestions, not instructions or guarantees. The seller may reject any offer, accept another buyer, withdraw, change terms or act irrationally. PMD does not know every competing offer, seller motivation, chain, private conversation or fact affecting negotiations.
A figure described as evidence-supported is not your personal maximum. Only you can decide what the property is worth to you and what you can afford.
3.8 Seller-specific terms
A Seller Property Intelligence Report is not an instruction to sell and does not create an estate-agency relationship. Marketing strategy may justify an asking price above, below or around an estimated market value. A professional appraisal may identify facts that materially change an automated estimate.
3.9 Reliance and third parties
The report is supplied to the purchasing account holder for their private use in connection with the identified property. It is not prepared for a lender, purchaser, seller, investor, court, HMRC, insurer or other third party. No third party may rely on it unless PMD expressly agrees in writing.
3.10 Your duty to verify
Before committing to a purchase, sale, mortgage, investment, building work or other significant decision, you should obtain the professional advice appropriate to the issue, including legal advice, survey, valuation, mortgage advice, insurance advice, tax advice or specialist environmental/building advice where relevant.
3.11 Report versions
A report reflects information and methodology available at the stated date and version. Markets and data change. PMD is not obliged to update an old report unless your product expressly includes updates. A later report may differ without either report having been negligently prepared.
3.12 Consumer statutory rights
Nothing in these terms excludes your statutory rights. Where the law requires digital content or services to be of satisfactory quality, fit for a particular purpose made known and supplied with reasonable care and skill, those rights apply.
3.13 Liability
Subject to the section headed “Liability that cannot be excluded”, PMD is not responsible for losses caused by matters outside the reasonable scope of the product, including a party choosing a different price, market movement after the report date, inaccurate customer information, undisclosed defects, lender decisions, survey findings, conveyancing issues, title matters, chain collapse, third-party fraud, supplier data errors that PMD could not reasonably identify, or a user treating an estimate as a guarantee. This does not apply to the extent that a loss is caused by our breach of this contract, including any failure to meet the standards described in clause 3.12.
For consumer claims where limitation is legally permitted, PMD will only be responsible for losses that were reasonably foreseeable when the contract was made and caused by our breach. We are not responsible for business losses suffered by a consumer acting wholly or mainly for private purposes.
Liability that cannot be excluded
Nothing in any PMD term, notice, disclaimer or contract excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of obligations or rights that cannot lawfully be excluded, or any other liability to the extent that exclusion or limitation is prohibited by law.
Any exclusion, limitation or disclaimer is intended to apply only to the fullest extent permitted by applicable law. If part of a term is unenforceable, it should be interpreted or severed to the minimum extent necessary without invalidating the remainder where the law permits.
Consumer terms must be fair, transparent and prominent where required. A disclaimer does not override statutory consumer rights.
