Version 7 October 2026
Effective from 8 October 2026
Property intelligence is inherently uncertain. PMD combines information from multiple sources and may derive, model, infer or estimate additional information. Each report should identify important sources, dates, assumptions and confidence where practical.
8.1 Public and licensed sources
Sources may include HM Land Registry price-paid data, EPC records, property listings, planning information, geographic/environmental datasets, public-sector datasets and licensed commercial sources. Source ownership remains with the relevant owner.
8.2 Timing
Datasets update on different schedules. A transaction, listing change, planning event, EPC, flood update or market movement may not yet appear. “Current” means current within the refresh cycle of the relevant source, not necessarily real-time.
8.3 Derived and modelled information
A derived or modelled figure is not an observed fact. Examples include time-adjusted sale prices, estimated value, price-per-square-foot analysis, confidence scores, buyer appeal, saleability, likely competition, project deductions, inferred market position and estimated rebuild costs.
8.4 Environmental and risk data
Flood, environmental, planning, crime, broadband, school and similar information is screening-level property intelligence unless expressly identified otherwise. It must not replace specialist searches, environmental reports, surveys, insurer checks, local-authority enquiries or legal due diligence.
8.5 No warranty of completeness
PMD takes reasonable steps appropriate to the product to process data accurately, but does not warrant that every underlying third-party record is complete, current or error-free. Where the law does not permit a warranty to be excluded, this clause is limited accordingly.
8.6 Material discrepancies
If a report identifies a discrepancy, missing information or low confidence, that is a warning to investigate, not an invitation to ignore the issue. You should not rely on the more favourable version merely because it suits your intended transaction.
Liability that cannot be excluded
Nothing in any PMD term, notice, disclaimer or contract excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of obligations or rights that cannot lawfully be excluded, or any other liability to the extent that exclusion or limitation is prohibited by law.
Any exclusion, limitation or disclaimer is intended to apply only to the fullest extent permitted by applicable law. If part of a term is unenforceable, it should be interpreted or severed to the minimum extent necessary without invalidating the remainder where the law permits.
Consumer terms must be fair, transparent and prominent where required. A disclaimer does not override statutory consumer rights.
